A Sydney teenager accused of sparking the Cronulla race riot by assaulting a lifesaver had turned his back on his culture and on Australia, a magistrate said. Ali Osman, 18, of Bankstown, was sentenced to 300 hours community service after pleading not guilty to the assault of a lifesaver at North Cronulla Beach on December 4, 2005.

The attack triggered the December 11 Cronulla riot involving a crowd of up to 5,000, during which people of Middle Eastern appearance were chased and attacked.

A Sydney man will spend seven weeks in protective custody after losing a sentence appeal over his role in the Cronulla riot. Mitchell John Newby, 20, was among a group that swarmed onto a train carriage at Cronulla railway station on December 11 last year and attacked two Middle Eastern men.

Newby admitted to police he kicked and punched one of the men as part of the attack. He was sentenced in April to a minimum three months jail on a riot charge, and granted NSW Supreme Court bail pending Thursday's appeal.

He told police he was motivated by an earlier assault against him and his girlfriend by a group of Middle Eastern men.

A CRONULLA rioter who wore a singlet with an inflammatory message will spend at least six months in jail after losing an appeal against his sentence today.

Marcus Kapitza, 28, of Penrith in Sydney's west, appealed his sentence of one-year in prison with a non-parole period of six months, handed down in August. Kapitza had pleaded guilty to one charge of riot arising from the December 11 race riot at North Cronulla last year.

He had worn a singlet he made at home which carried the words "Mohammed was a camel raping faggot". In Sydney's Downing Centre District Court today, Kapitza expressed remorse for his participation in the riot.
